Muslim girl can marry at 15 if attains puberty: HC

Ruling that a Muslim girl can marry as per her choice at the age of 15 years if she has attained puberty, the Delhi high court has held the marriage of a minor girl valid and allowed her to stay in her matrimonial house.

"This court notes that according to Mohammedan Law a girl can marry without the consent of her parents once she attains the age of puberty and she has the right to reside with her husband even if she is below the age of 18....," a bench of justices S Ravindra Bhat and SP Garg said.

Citing various Supreme Court judgements on the issue of minor Muslim girls' marriage, the bench said "In view of the above judgments, it is clear that a Muslim girl who has attained puberty i.e. 15 years can marry and such a marriage would not be a void marriage. However, she has the option of treating the marriage as voidable, at the time of her attaining the age of majority, i.e 18 years."

Guru 09/06/2012 01:02:58	Debate needed. Please do not condemn but debate ! Shehab has a valid point that muslims are also struggling with fundamentalists within their community. He seems to be one such muslim who thinks that this is wrong. Let us not blanket condemn people simply because of their birth. Every person has a brain capable of receiving illumination. It is the duty of every human being (and every Hindu thus) to work on this Dharma principle. Now coming back to this law or act. Such special laws/interpretations cause various social problems. For example I have heard of Hindu and Christian married men converting to Islam to remarry without divorcing their current wife. I think this 15 year law is dangerous and may cause conversion or forced conversion to legitimize what will otherwise be a crime. Such laws should be thoroughly debated by society as a whole.

shehab 07/06/2012 09:44:24	bad articles dear HK...iam a muslim and more over iam an indian and like indian-hindu culture too..i like my religion and at the same time prous to be an indian and respect antoher religions also.... i was just wonder why HK always publish articles which insults islam.... try to input good articles which shows the spirit of our indian culture ...in our country there are lot of muslims and lot of hindus living together peacefully. HK should concentrate on the development of hindu religion and indian culture...not always blaming muslims and concentrating on muslim issues.....

The institution of judiciary itself functions now as an agent of discrimination in the contemporary India. The judgement is the latest example to the judicial murder of Mother India. The message of the judgement is, no doubt, is an advise to Muslims that to seek the advise of Deoband seminary or illiterate Mullas for the interpretation of Indian Muslims legal questions. Then why allow Mohammedans to follow Islamisim and foolish Mullah interpretation of cruel Sharia codes. Recently a Mullah has issed a decree where any Mohammedan is allowed to have sex with a dead women. Polygamy and deviant sex may be a practice of all Islamists. But why a secular country allow Sharuia codes to be interpreted and implemented by Mohammedans. Islamists are always wrong in their attitudes toward dealings with young grils and women. Muslim-exclusive IITs and IIMs, Muslim-exclusive Kendriya Vidyalayas, Muslim-exclusive scholarships and banks and the rest exclusive to Muslims. Are such Muslim-exclusive institutions solutions for the problems of Muslims? Or being exclusive is the very cause of their problems?
